Terms of Service

Welcome to Akono. These Terms of Service ("Terms") govern your use of the Akono platform and services (the "Service") provided by Akono B.V. ("Akono," "we," "us," or "our"). The Service includes our website at akono.ai and our mobile applications for iOS and Android.

By creating an account or using our Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About Akono

Akono is an AI-powered adaptive learning platform that transforms your study materials into personalized learning experiences. The Service is designed as a study aid to support your learning. It is available through our website and through our mobile apps, on the same account: what you study on one appears on the other.

2. Eligibility

You must be at least 16 years old to use Akono. By using the Service, you represent that you meet this age requirement.

3. Your Account

3.1 Account Creation

To use Akono, you must create an account using a valid email address or through Google sign-in. You agree to provide accurate information and keep your account credentials secure.

3.2 Account Security

You are responsible for all activity that occurs under your account. Notify us immediately at [email protected] if you suspect unauthorized access.

3.3 Account Termination

You may delete your account at any time through the Service. We may suspend or terminate your account if you violate these Terms.

4. Subscriptions and Payments

4.1 Plans and Free Trial

Akono is a paid subscription service ("Limitless"). New users can start with a 3-day free trial. Starting the trial requires a valid payment method, and unless you cancel before the trial ends, your paid subscription begins automatically when the trial ends. Current pricing and plan features are shown during sign-up and on our website at akono.ai.

4.2 Billing

Paid subscriptions are billed in advance on a monthly or annual basis, depending on the plan you select. Who processes the payment depends on where you subscribe: subscriptions bought on our website are processed by Stripe, and subscriptions bought inside our mobile apps are processed by Apple or Google as described in Section 4.7.

4.3 Free Trial and Automatic Renewal

If you start a free trial, you will not be charged during the trial period. Unless you cancel before the trial ends, your paid subscription begins automatically and your payment method is charged when the trial ends. After that, subscriptions renew automatically at the end of each billing period, and you will be charged the then-current rate unless you cancel before the renewal date.

4.4 Price Changes

We may change our prices from time to time. For existing subscribers, price changes will take effect at the start of your next billing period following notice of the change. Continued use of the Service after a price change constitutes acceptance of the new price.

4.5 Cancellation

You may cancel your subscription or free trial at any time. Upon cancellation:

  • If you cancel during a free trial, you will not be charged
  • If you cancel a paid subscription, you retain access until the end of your current billing period
  • Your access to paid features ends after that, and no further charges will be made

4.6 Refunds

Free trial: You will not be charged if you cancel before your free trial ends. The refund terms below apply to charges made after the trial.

Annual subscriptions: If you cancel your annual subscription, you may request a prorated refund for the unused portion of your subscription term. Refund requests must be made within 14 days of cancellation by contacting [email protected].

Monthly subscriptions: Monthly subscriptions are non-refundable.

Processing: Approved refunds are processed within 10 business days to your original payment method.

4.7 Purchases Made Inside Our Mobile Apps

If you subscribe inside our iOS or Android app, the purchase is made through your Apple App Store or Google Play account, and those stores — not Akono — process the payment. The following applies to those purchases, and takes precedence over Sections 4.2, 4.5 and 4.6 where they differ:

  • The price and any free trial are shown by the store before you confirm, in your local currency, and are charged to the payment method on your store account.
  • Your subscription renews automatically unless you turn off auto-renewal at least 24 hours before the end of the current period. If you started a free trial, the paid subscription begins automatically when the trial ends unless you cancel before then.
  • You cancel through the store, not through us. On iOS this is Settings → your name → Subscriptions; on Android it is Google Play → Payments and subscriptions. We cannot cancel a store subscription on your behalf.
  • Refunds for these purchases are handled by Apple or Google under their own policies, and our refund terms in Section 4.6 do not apply to them. We will help where we can, but the decision is the store's.
  • Any unused part of a free trial is forfeited if you buy a subscription before the trial ends.

4.8 Apple App Store

Where you obtained the app from Apple, the following applies and is required by Apple:

  • These Terms are between you and Akono only, not with Apple. Akono, not Apple, is solely responsible for the app and its content.
  • Apple has no obligation to provide any maintenance or support for the app.
  • If the app fails to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price of the app to you. To the maximum extent permitted by law, Apple has no other warranty obligation with respect to the app.
  • Akono, not Apple, is responsible for addressing any claim relating to the app, including product liability claims, any claim that the app fails to conform to a legal requirement, and claims under consumer protection or similar legislation.
  • Akono, not Apple, is responsible for the investigation, defense, settlement and discharge of any third-party claim that the app or your use of it infringes that third party's intellectual property rights.
  • You represent that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country, and that you are not on any U.S. Government list of prohibited or restricted parties.
  • Apple and its subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance Apple will have the right to enforce them against you as a third-party beneficiary.

5. Your Content

5.1 Ownership

You retain ownership of all content you upload to Akono ("Your Content"), including study materials, documents, and any data you create within the Service.

5.2 License to Us

By uploading content, you grant Akono a limited license to process, store, and transform Your Content solely to provide the Service to you. This includes:

  • Processing documents with AI to generate courses
  • Storing course content and learning data
  • Displaying content back to you

This license terminates when you delete Your Content or your account.

5.3 Your Responsibilities

You represent and warrant that:

  • You have the right to upload and use all content you submit
  • Your Content does not violate any third party's intellectual property rights
  • Your Content does not contain malware, viruses, or harmful code
  • Your Content does not contain illegal material

5.4 Content Removal

We reserve the right to remove content that violates these Terms, without prior notice.

5.5 Reporting Illegal or Infringing Content

If you believe content hosted on Akono infringes your intellectual property rights or is otherwise illegal, please send a notice to [email protected] including:

  • Your name and contact details
  • A clear description of the content and where it is located on the Service
  • An explanation of why the content is infringing or illegal, including reference to the specific right or law
  • A statement that the information in your notice is accurate and, for copyright claims, that you are the rights holder or authorized to act on their behalf

We will review notices promptly, take appropriate action where warranted, and inform you and the affected user of the outcome. This mechanism is provided in accordance with our obligations under the EU Digital Services Act (Regulation 2022/2065).

5.6 Repeat Infringers

We will terminate the accounts of users who are determined, in our reasonable judgment, to be repeat infringers of intellectual property rights or who repeatedly upload illegal content.

6. Acceptable Use

You agree not to:

  • Upload content that infringes third-party intellectual property rights or that is otherwise illegal under applicable law
  • Use the Service in any way that violates applicable law
  • Attempt to gain unauthorized access to any part of the Service
  • Interfere with or disrupt the Service or its infrastructure
  • Use automated means to access the Service without our permission
  • Resell, sublicense, or commercially exploit the Service
  • Reverse engineer or attempt to extract the source code of the Service
  • Use the Service to develop a competing product

7. Intellectual Property

7.1 Our Property

The Service, including its design, features, code, and AI models, is owned by Akono and protected by intellectual property laws. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service.

7.2 Feedback

If you provide suggestions or feedback about the Service, you grant us the right to use that feedback without restriction or compensation.

8. AI-Generated Content

Akono uses artificial intelligence to generate educational content, including questions, explanations, and study materials. You acknowledge that:

  • AI-generated content may contain errors or inaccuracies
  • You should verify important information independently
  • AI-generated content is provided for educational purposes only

9. Service Availability

9.1 Availability

We strive to keep the Service available, but we do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.

9.2 Modifications

We may modify, update, or discontinue features of the Service at any time. For significant changes that negatively affect paid subscribers, we will provide reasonable notice.

10. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

  • The Service will meet your specific requirements
  • The Service will be uninterrupted, timely, secure, or error-free
  • The results obtained from the Service will be accurate or reliable
  • Any errors in the Service will be corrected

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, AKONO SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM THESE TERMS OR THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR €100, WHICHEVER IS GREATER.

These limitations apply regardless of the theory of liability and even if we have been advised of the possibility of such damages.

Note for EU users: These limitations do not affect your statutory rights as a consumer under EU law, including rights under the Consumer Rights Directive.

12. Indemnification

You agree to indemnify and hold harmless Akono and its officers, directors, and employees from any claims, damages, losses, or expenses (including reasonable legal fees) arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third party's rights
  • Content you upload to the Service

13. Privacy

Your privacy is important to us. Our collection and use of personal data, including how long we retain uploaded study materials, is governed by our Privacy Policy, available at akono.ai/privacy. By using the Service, you consent to our data practices as described in the Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by:

  • Posting the updated Terms on our website
  • Updating the "Last updated" date
  • Sending an email notification for significant changes

Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree to the changes, you must stop using the Service.

15. Termination

15.1 By You

You may stop using the Service and delete your account at any time.

15.2 By Us

We may suspend or terminate your access to the Service immediately, without prior notice, if:

  • You breach these Terms
  • We are required to do so by law
  • We discontinue the Service

15.3 Effect of Termination

Upon termination:

  • Your right to use the Service ceases immediately
  • We may delete your account and content
  • Provisions that by their nature should survive termination will survive (including Sections 5.1, 7, 10, 11, 12, and 16)

16. General Provisions

16.1 Governing Law

These Terms are governed by the laws of the Netherlands, without regard to conflict of law principles.

16.2 Dispute Resolution

Any disputes arising from these Terms or the Service shall be submitted to the exclusive jurisdiction of the courts of Amsterdam, the Netherlands.

For consumers residing in the EU: You may also bring proceedings in the courts of your country of residence, and you retain any rights available under mandatory consumer protection laws in your country.

16.3 Entire Agreement

These Terms, together with the Privacy Policy, constitute the entire agreement between you and Akono regarding the Service.

16.4 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in effect.

16.5 No Waiver

Our failure to enforce any right or provision of these Terms does not constitute a waiver of that right or provision.

16.6 Assignment

You may not assign your rights under these Terms without our consent. We may assign our rights without restriction.

By using Akono, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service.
